The Constitution of Perak

Perak is a constitutional monarchy led by the DYMM Paduka Seri Sultan of Perak who is a hereditary ruler.

The laws of the constitution of the state (Undang-Undang Tubuh Kerajaan Perak) is broadly divided into Parts I and II. Part I was written and confirmed on 21 Rabi’ul Awal 1367H (1 February 1948) during the reign of Almarhum Sultan Abdul Aziz, and concerns various sets of rules, divided as articles 1 to 64, which include matters concerning definition of the official religion of the state and its Head, executive authority, special provisions related to the Malays, the legislative assembly (Dewan Negeri) and the executive council (Majlis Mesyuarat Kerajaan).

The wording of Part 1 the constitution begins as follows:

“RAJA ABDUL AZIZ (IN MALAY)
(Ruler’s Sign Manual with seal at the end)

In the name of GOD, the Compassionate, the Merciful, PRAISE be to GOD, the Lord of the Universe, and may the benediction and peace of GOD be upon Our Leader Muhammad and upon all his Relations and Friends.

“BY THE GRACE OF GOD WE ABDUL AZIZ ALMU’TASIM BILLAH SHAH IBNI AL’MARHUM RAJA MUDA MUSA of the State and Territory of Perak and all its Dependencies, Sultan, Yang di-Pertuan and Ruler, Knight Commander of the Most Distinguished Order of St. Michael and St. George, Knight Commander of the Most Excellent Order of the British Empire.

“WHEREAS we have undertaken in the Agreement which WE have made with HIS MAJESTY on the twenty-first day of January, 1948  (hereinafter called “The Perak Agreement, 1948”), to govern OUR State of Perak subject to the provisions of a written Constitution which shall be in conformity with the said Agreement and also with the further Agreement which WE have made with HIS MAJESTY on the twenty-first day of January, 1948 (hereinafter called “the Federation of Malaya Agreement, 1948”):

“AND WHEREAS we have agreed in the Perak Agreement, 1948, that the said written Constitution shall be granted and promulgated by US as soon as conveniently may be or, if WE think expedient, in Parts from time to time:

“AND WHEREAS in pursuance of OUR undertaking given in the Perak Agreement, 1948, it is necessary forthwith that WE should empower and appoint two Councils to aid and advise us in the Government of OUR State of Perak, that is to say, a Majlis Mesyuarat Kerajaan, to be called in English, State Executive Council, and a Majlis Mesyuarat Negeri, to be called in English Council of State, and WE deem it expedient that WE should make certain further provisions for the government and well-being of OUR State of Perak:

“AND WHEREAS WE think it expedient that the empowering and appointment of the said two Councils and the making of the said further provisions should form the First Part of the said written Constitution:

“Now THEREFORE WE, by the rights and powers of OUR Prerogatives as Sultan and Ruler of the State of Perak and with the advice concurrence and consent of OUR Major Chiefs and Elders of OUR STATE of Perak, do HEREBY DECLARE AND ORDAIN IN OUR Name, and on OUR behalf, and for and on behalf of OUR Successors, As hereinafter follows:”

Part II was written and confirmed on 11 Jamadil Akhir 1372H (25 February 1953) during the reign of Almarhum Sultan Yusuf Izzudin, and concerns articles (1 to 78) related to the sovereign (the Sultan), the appointments of the sovereign and titled Raja, the Royal Seal, the Dewan Negara and matters concerning the Orang Besar. The wording of Part II begins as follows:

“RAJA YUSSUF (IN ENGLISH)
(Ruler’s Sign Manual and State Seal)

In the name of GOD, the Compassionate, the Merciful, PRAISE be to GOD, the Lord of the Universe, and may the benediction and peace of GOD be upon Our Leader Muhammad and upon all His Relations and Friends.

“BY THE GRACE OF GOD WE, YUSSUF IZZUDIN SHAH IBNI AL-MARHUM SULTAN ABDUL JALIL of the State and Territory of Perak and all its Dependencies, Sultan, Yang di-Pertuan and Ruler, Knight Commander of the Most Distinguished Order of St. Michael and St. George, Officer of the Most Excellent Order of the British Empire.

“WHEREAS OUR PREDECESSOR AL-MARHUM NAEMATULLAH SHAH granted and promulgated an the First day of February, 1948, the First Part of the Undang-Undang Tubuh Kerajaan, Perak, called in English the Laws of the Constitution of Perak, and reserved to US and OUR Successors by virtue of Article 2 of such First Part the right to declare and ordain a subsequent part or parts of the said Laws.

“AND WHEREAS WE think it expedient at the present time to grant and promulgate a Second part of the said Laws:

“Now THEREFORE WE, by the rights and powers of OUR Prerogative as Sultan and Ruler of the State of Perak and with the advice, concurrence and consent of OUR Major Chiefs and Elders, after consultation with the State Executive Council, of OUR State of Perak, DO HEREBY DECLARE AND ORDAIN in OUR name, and on OUR behalf, and for and on behalf of OUR Successors, as hereinafter follows:”
